Welcome to GoBallistic. By downloading, installing, or using our mobile application or this website (collectively, "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Description of Service

GoBallistic is an AI-powered firearm identification application operated by StrataLogic ("we," "our," "us"). The Service uses machine learning to identify firearms from photographs, provide historical and technical information, locate nearby retailers, and surface media appearances. The Service may include free and paid (Pro) tiers.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms.

3. AI Identification Disclaimer — Important

Firearm identifications produced by the Service are generated by artificial intelligence and are provided for informational and educational purposes only. Identifications may be inaccurate, incomplete, or outdated. The Service is not a substitute for:

• Professional firearm appraisal or authentication
• Legal compliance verification (e.g., NFA, state laws)
• Safety inspection by a qualified gunsmith
• Law enforcement, forensic, or evidentiary use

You agree not to rely on the Service for any decision involving safety, legal compliance, financial transactions, or law enforcement matters. We make no warranty regarding the accuracy of any identification, specification, or related information.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any local, state, federal, or international law
• Attempt to reverse engineer, decompile, or extract source code from the Service
• Bypass any rate limits, paywalls, or access controls (including the daily free tier)
• Use automated systems or bots to interact with the Service
• Submit images that contain illegal content or that you do not have the right to submit
• Resell, redistribute, or commercially exploit identification results without written permission
• Use the Service to harass, threaten, or harm others

5. Pro Subscription

Pro subscriptions are offered as monthly, yearly, or one-time lifetime purchases. Recurring subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date. Subscription management (including cancellation) is handled through your Google Play subscriptions settings.

All purchases are final and non-refundable except as required by applicable law or by the policies of Google Play. Lifetime purchases entitle you to access Pro features for the operational life of the App; if the App is discontinued, no refund is owed.

6. Intellectual Property

The Service, including all trademarks (including "GoBallistic"), logos, software, designs, content, and aggregated data, is owned by StrataLogic and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. All other rights are reserved.

Third-party content displayed in the Service (movie posters via TMDB, IMFDB excerpts, retailer logos, etc.) is the property of its respective owners and is used under license or fair use.

7. Affiliate Disclosure

Some links in the Service are affiliate links. We may earn a commission from qualifying purchases made through these links at no additional cost to you. This includes links to Amazon (Amazon Associate program), online firearm retailers, and streaming services. Affiliate revenue helps fund continued development of the Service.

8. Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT IDENTIFICATIONS WILL BE ACCURATE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL STRATALOGIC, ITS AFFILIATES, OFFICERS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR US$50, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless StrataLogic from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time by uninstalling the App.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated Effective Date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Delaware.
