Terms of Service

Welcome to GoBallistic, a product of StrataLogic LLC ("StrataLogic," "we," "our," "us"). By downloading, installing, or using the GoBallistic mobile app (the "App") or the website at goballistic.app (together with the App, the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. The Service

GoBallistic uses artificial intelligence to identify firearms from your photos. It provides reference information such as the likely maker, model, caliber, era, specifications, history, an estimated value range, and film and TV appearances. On iPhone, Where to Buy also lists nearby firearm dealers and links to online retailers' websites; the Android app does not include Where to Buy. GoBallistic is an identification and reference tool: we do not sell, broker, or ship firearms, ammunition, or accessories, and you cannot buy them through the Service. The Service has a free tier, which includes a limited number of identifications per day and shows ads, and a paid Pro tier.

2. Eligibility

You must be at least 18 years old to use the Service. By using it, you confirm that you are 18 or older and able to agree to these Terms.

3. AI results are estimates

Identifications, specifications, history, and estimated value ranges are generated by artificial intelligence from your photos and other reference sources and are provided for informational and educational purposes only. They may be inaccurate, incomplete, or out of date. In particular:

Do not rely on the Service for any decision involving safety, legal compliance, buying or selling, or law enforcement matters. Verify important details independently.

4. Firearm laws and safety

Laws on buying, owning, possessing, carrying, transporting, selling, transferring, and shipping firearms, ammunition, and accessories differ between countries, states, and cities, and many transfers must go through a licensed dealer with a background check. Some firearms, parts, and accessories are restricted or banned in some places, for example items regulated under the National Firearms Act. GoBallistic provides general information only. It does not provide legal advice and does not tell you whether a firearm, part, or accessory is legal for you to buy, own, carry, or transfer where you are. You are responsible for knowing and following the laws that apply to you. Treat every firearm as if it is loaded, and store firearms securely.

6. Pro, purchases, and ads

Pro is available as a monthly or yearly subscription or as a one-time lifetime purchase. Monthly and yearly subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends.

All purchases are final and non-refundable, except as required by law or by the refund policies of Google Play or the Apple App Store. If a purchase is refunded or charged back, the Pro access it provided ends. A lifetime purchase gives you access to Pro features for as long as we operate the App; if the App is discontinued, no refund is owed. The free tier shows ads, and some features can be unlocked by watching a rewarded ad, such as an extra identification for the day or the film and TV appearances for one identification. Free-tier limits, rewarded-ad offers, and Pro features may change over time.

7. Dealers, links, and affiliate disclosure

On iPhone, Where to Buy shows third-party firearm dealers, including listings provided by Google and dealers that partner with us, and links to online retailers' websites. We do not own or operate these businesses, and we are not responsible for their products, prices, listings, or conduct. Any purchase is between you and the seller and must comply with the law, including any requirement to complete a transfer through a licensed dealer. Links to other websites and services are governed by their own terms and privacy policies.

Some links in the Service, including some links on our website, are affiliate links, which means we may earn a commission from qualifying purchases at no extra cost to you. As an Amazon Associate, we earn from qualifying purchases.

8. Your photos

You keep any rights you have in the photos you submit. You give us permission to process them to provide the Service, as described in our Privacy Policy.

9. Intellectual property

The Service, including the GoBallistic name and logo, our software, designs, and the content we create, is owned by StrataLogic LLC and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for non-commercial purposes. All other rights are reserved.

Names of firearm makers, brands, and models are trademarks of their respective owners and are used only to identify firearms; GoBallistic is not affiliated with or endorsed by them. Third-party content shown in the Service, such as film and TV information and posters from TMDB, information from IMFDB (the Internet Movie Firearms Database), dealer information from Google, and retailer names and logos, belongs to its respective owners. This product uses the TMDB API but is not endorsed or certified by TMDB.

10. App stores

These Terms are between you and StrataLogic, not Apple or Google, and we alone are responsible for the App. If you downloaded the App from the Apple App Store, Apple's Licensed Application End User License Agreement also applies. If you downloaded it from Google Play, your use is also subject to the Google Play Terms of Service.

Our Privacy Policy explains how we handle information, and it is part of these Terms.

12. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT IDENTIFICATIONS, SPECIFICATIONS, OR ESTIMATED VALUES WILL BE ACCURATE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL STRATALOGIC LLC, ITS AFFILIATES, OFFICERS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING ANY DECISION YOU MAKE BASED ON ITS RESULTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR US$50. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless StrataLogic LLC from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of the rights of another party.

15. Termination

We may suspend or end your access to the Service at any time, with or without notice, including if you violate these Terms. You may stop using the Service at any time by uninstalling the App.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date above. Continued use of the Service after a change means you accept the updated Terms.

17. Governing law

These Terms are governed by the laws of the United States and the state in which StrataLogic LLC is organized, without regard to conflict-of-law principles.
